Recent Developments in RMLA Continuing Education Litigation

 

Injunction dissolved, lawsuit dismissed.

Effective April 7, 2008, the court order enjoining the Office of Financial Institutions from enforcing the provisions of Act 34 of 2007, regarding education requirements for RML license renewal, was set aside, and the lawsuit was dismissed. The time for affected parties to seek post judgment relief has expired, and the dismissal and dissolution orders issued by the trial court are final.

 

Act 34 now applies to renewal applications.

Consequently, the provisions of Act 34 of 2007 apply to any application for renewal of a RML license made after April 7, 2008.

Considering that existing laws are subject to amendment by the Legislature, and to interpretation and injunction by the Courts, you are encouraged to consult this website for further developments in this regard, and prior to filing a RML license renewal application.  For example, Act 531 of the 2008 Regular Session, effective

June 30, 2008 amended the RML continuing legal education requirements by reducing the number of hours of education required for license renewal from 10 hours to 8 hours. Further information about this Act and other legislation affecting RML activities will be posted to this website at a future date.
